HEALTH: Seller certifies that this puppy is a purebred Miniature Poodle of sound body, good health, and free of communicable diseases at the time of placement. This puppy has been checked by a veterinarian and has been found to be healthy and has received appropriate vaccinations and de-worming medication. Buyer is encouraged to have the puppy examined by their own veterinarian within three (3) days after adoption. If puppy is found to have serious or life-threatening illness, Seller must be provided with a written report of the health problem from Buyer's veterinarian immediately within this 72 hour period for refund or replacement puppy, at Seller’s option. The Buyer assumes full responsibility for all costs and care during this time.
SPAY/NEUTER: Puppy is purchased as a Pet and May Not Be Bred (intentionally or unintentionally). Buyer agrees to spay or neuter this puppy between the age of six and nine months of age. Registration papers will be presented to buyer after documentation of spay/neuter procedure is received by Seller from licensed veterinarian.
REGISTRATION: Seller assures that this puppy is purebred and registerable, and that the litter from which this puppy originated has been registered with the American Kennel Club of America (AKC). The Buyer has the option of naming their new dog with the understanding that all puppies carry the name "Avant’s" at the front of their registered name. Registration application will be held until puppy is spayed or neutered by a licensed veterinarian and documentation of procedure is received by Avant Poodles.
GENERAL: Buyer agrees to provide this dog with adequate care, grooming, nutrition and a full round of available vaccinations and veterinary care during the term of its life. Buyer agrees not to mistreat or neglect this pet at any time.
NOTIFICATON: If Buyer becomes unable to keep puppy at any time, for any reason, Seller must be notified of the situation in writing before pet is re-homed, sold or surrendered. All notices provided to be given under this Contract shall be given by U.S. certified mail or registered mail, addressed to the Seller, at the following address:

APPLICABLE LAW: This Contract shall be construed under and in accordance with the laws of the State of Florida.
LEGAL CONSTRUCTION: In case any one or more of the provisions contained in this Contract shall for any reason be held to be invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provision thereof and this Contract shall be construed as if such invalid, illegal or unenforceable provision had never been contained herein.
SOLE AGREEMENT OF THE PARTIES: This Contract constitutes the sole and only agreement of the parties hereto and supersedes any prior understandings or written or oral agreements between the parties respecting the subject matter within it.
AMENDMENT: No amendment, modification or alteration of the terms hereof shall be binding unless the same be in writing, dated subsequent to the date hereof, and duly executed by the parties hereto.
RIGHTS AND REMEDIES CUMULATIVE: The rights and remedies provided by this Contract are cumulative and the use of any one right or remedy by either party shall not preclude or waive its right to use any or all other remedies. Said rights and remedies are given in addition to any other rights the parties may have by law, statute, ordinance or otherwise.
ATTORNEY’S FEES: In the event Sellerr or Buyer breaches any of the terms of this Contract whereby the party not in default employs attorneys to protect or enforce its rights hereunder and prevails, then the defaulting party agrees to pay the other party reasonable attorney's fees so incurred by such other party.
